Agreement to Terms

These Terms of Service (“Terms”) govern your access to and use of the zenchess mobile application and related services (collectively, the “Service”) provided by zenchess (“we,” “our,” or “us”).

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

Use of the Service

Eligibility

You must be at least 13 years old to use the Service. By using the Service, you represent and warrant that you meet this age requirement.

Account Registration

To access certain features of the Service, you may be required to create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Notify us immediately of any unauthorized use of your account
  • Accept responsibility for all activities that occur under your account

Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

  • Use the Service in any way that violates applicable laws or regulations
  • Attempt to gain unauthorized access to any part of the Service or related systems
  • Interfere with or disrupt the Service or servers/networks connected to the Service
  • Reverse engineer, decompile, or disassemble any portion of the Service
  • Use automated systems (bots, scrapers) to access the Service without our permission
  • Upload or transmit viruses, malware, or other malicious code
  • Harass, abuse, or harm other users of the Service

Intellectual Property Rights

The Service and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, and the design, selection, and arrangement thereof) are owned by zenchess, its licensors, or other providers of such material and are protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, republish, download, store, or transmit any of the material on our Service without our prior written consent.

User-Generated Content

The Service may allow you to create, submit, or display content such as profile information, training data, or feedback (“User Content”). You retain all rights in, and are solely responsible for, the User Content you make available through the Service.

By making any User Content available through the Service, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and distribute such content solely for the purpose of operating and improving the Service.

Beta Testing

The Service is currently in beta testing. As a beta user, you acknowledge and agree that:

  • The Service may contain bugs, errors, or other issues
  • Features may be added, modified, or removed without notice
  • Data loss may occur, and we recommend not relying on the Service for critical data storage
  • The Service is provided “as is” during the beta period
  • We may discontinue the beta program or your access to it at any time

Subscriptions and Payments

Some features of the Service may require a paid subscription. By purchasing a subscription, you agree to:

  • Pay all fees associated with your subscription
  • Provide accurate and complete billing information
  • Allow automatic renewal unless you cancel before the renewal date

Cancellation: You may cancel your subscription at any time through your app store account settings (Apple App Store or Google Play Store). Cancellations will take effect at the end of the current billing period.

Refunds: Refunds are subject to the refund policies of the Apple App Store or Google Play Store, as applicable. We do not provide direct refunds.

Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, or error-free, or that defects will be corrected. Your use of the Service is at your own risk.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZENCHESS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your access to or use of (or inability to access or use) the Service
  • Any conduct or content of any third party on the Service
  • Unauthorized access, use, or alteration of your transmissions or content

Indemnification

You agree to indemnify, defend, and hold harmless zenchess and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service or violation of these Terms.

Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause or notice, if we believe you have violated these Terms or for any other reason at our sole discretion.

You may terminate your account at any time by deleting the app and ceasing to use the Service. Upon termination, your right to use the Service will immediately cease.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which zenchess operates, without regard to its conflict of law provisions.

Changes to These Terms

We reserve the right to modify or replace these Terms at any time. We will provide notice of any material changes by posting the new Terms on this page and updating the “Last updated” date. Your continued use of the Service after any changes constitutes acceptance of the updated Terms.
